Competition Rules / Terms and Conditions

The following rules together with Kingfisher FM's general and competition terms and conditions apply to Kingfisher FM’s Talent in the Town competition which will run from 28th October – 5th November 2009.

Anyone who enters the Competition, an entrant, will be deemed to have understood these rules along with the Terms and Conditions and will be bound by them. Our general and competition terms and conditions are available on request from Kingfisher FM.


Details of the Competition
This competition is open to any solo singer, band, vocal group, community performance group and anyone else who believes they can either sing or play instruments or both individually or in a group.

To enter the Competition an entrant must go online to www.talentinthetown.co.uk and register their details via the apply page. Online entry will open at Midday on Monday 28th September 2009 and close at 11.30pm on Sunday 18th October 2009.

Entrants must be available during all heats and rounds and free on the day of the final from 4pm on the 5th November 2009.

Each artist must be able to set up and be ready to perform within 15 minutes and are limited to perform one FAMILY FRIENDLY track per performance which must last no longer than 5 minutes maximum. Any entrant who uses any bad language or shows abusive behaviour in any way during any performance will be banned from the competition and any future events held by Kingfisher FM, Talent in the Town and any Redditch Borough Council public event.

For artists using backing tracks Kingfisher FM will provide computerised, CD and Minidisk playout systems but it is the responsibility of each entrant to ensure they have sufficient backup copies on different formats as Kingfisher FM will not be held responsible should the media not play through our systems.

Heats will be held in front of a minimum of 3 judges and the judge’s decision is final - no correspondence will be entered into. The final will be decided by audience text vote at the Redditch Borough Council Fireworks display on the 5th November 2009. Should a tie/draw happen through the text vote the final votes will fall to the heat judges and their decision will be final - no correspondence will be entered into.

AGE RESTRICTIONS
There are no age restrictions on who can register or enter Talent in the Town however registrants under the age of eighteen (18) are required to obtain the consent and supervision at all times.

All groups whose members are children or minors under the age of 18 must have a minimum of 1 adult with them throughout any heat/round and at the final. Where more than one child is present the supervising adult must have signed parental consent forms from each of the minors parents before they are able to take part.

LIABILITY & INDEMNITY
The competition, website and any related information provided by Kingfisher FM is provided in good faith and up to date at the time of publishing but Kingfisher FM accept no responsibility for any loss or expense, consequential or otherwise, that may be incurred as a direct or indirect result of supporting or entering the competition.

Kingfisher FM undertake to make best endeavours to ensure that both the Kingfisher FM and Talent in the Town website contains no objectionable material and is free from viruses, spyware, malware and other technology based infestations but make no warranty implied or otherwise in this regard.

TEXT VOTE INFORMATION
The winner of Talent in the Town 2009 will be selected by the audience on the live final on the 5th November 2009 at the Redditch Borough Council Fireworks event at Arrow Vally Lake.

Voting can be done by anyone in the audience with a mobile phone and costs 50p per text plus your standard network rate per vote.

Voting can only be done between 19:30 and 20:00. Any votes placed before or after this time WILL NOT COUNT but you may still be charged. Please ensure you ask the bill payers permission before voting!

To place your vote on the night follow these 4 easy steps.

1. Create a new text message on your phone

2. in the TO: section (where you will usually add a contacts name or telephone number) add the number 60300

3. Start your message with the letters KFM then leave a space then add the number 1,2,3,4 or 5 depending on which entrant you would like to be crowned Kingfisher FM's Talent in the Town 2009 Winner.

4. Press Send

DO NOT ADD ANYTHING ELSE TO THE MESSAGE OTHER THAN KFM AND THE ENTRANT NUMBER OTHERWISE IT WILL NOT GO INTO OUR VOTING SYSTEM BUT YOU MAY STILL BE CHARGED. Text votes sent before 7:30pm on the 5th November 2009 and after 8pm on the 5th November 2009 will not be accepted BUT YOU MAY STILL BE CHARGED!!!

PRIVACY POLICY
Kingfisher FM’s Talent in the Town competition complies with UK legislation relating to your privacy and the protection of your personal data. Information that we collect via our registration & application process will not be divulged to third parties without your prior consent All information will be kept as secure as possible although information provided on the application form is done so at your own risk.

Kingfisher FM cannot be held responsible or accountable for any personal data that you provide to a third party via direct contact that may be made with them through the Talent In the Town or Kingfisher FM web site.

By Applying and registering with Kingfisher FM’s Talent In the Town the registered user agrees that any personal data provided to us may be used for direct contact from time-to-time regarding products or services provided by Kingfisher FM, to assist with Kingfisher FM’s research or to verify the Registered User's identity.

CONTENT & COPYRIGHT
All content and material contained on this web site are the intellectual property of Kingfisher FM. By accessing this site you agree not to copy, reproduce, republish or transmit content in any form either directly or indirectly to any other website, user group, bulletin board, mailing list, server or other storage device unless agreed in writing by Kingfisher FM.

In the event that a user is determined to be in breach of these conditions Kingfisher FM reserve the right to prevent further access to the Kingfisher FM and Talent In the Town websites by any means at their disposal including but not limited to the blocking of an IP address or addresses or address range and/or suspension of log-in privileges.

In the event that log-in privileges are suspended the Registered User shall have the right to appeal this decision by submitting an email to info@kingfisherfm.co.uk.

PROMOTIONS AND PUBLICITY
From time-to-time including during Talent in the Town Kingfisher FM may run promotional campaigns whereby awards, incentives, prizes and/or similar may be offered. By participating in Talent in the town and any other promotional campaign Subscribers and/or Registered Users agree that Kingfisher FM may use any images, recordings or anyother item for publicity both online and on air.

MODIFICATIONS
Kingfisher FM reserve the right to vary these Terms and Conditions from time-to-time and you accept that it is your responsibility to check the Kingfisher FM and Talent in the Town website periodically in order to appraise yourself of any changes. Your continued use and support of the competition and web site will be deemed to be an acceptance of the prevailing Terms and Conditions.

Prizes up for grabs to the winning talent:

We've teamed up with a local recording studio who will take the Winning artist(s) under their wing to help them produce a professional CD of their performance
and other tracks which can then be used
to promote the winner across the
midlands and beyond.
All the entrants who to get through to the
final will have the chance to play infront
of an audience of around 15,000 people
at the Redditch Borough Council Fireworks where the audience will decide by text
vote who the winner should be. The winner
will then be announced after the firework display where they'll have the chance to repeat their performance once again.
Not only wii the winner get plenty of promotion through Kingfisher FM at future events, online and on any future FM broadcast during the winners year they will also get promotion across the Midlands Community radio network giving the winner(s) a wider coverage.
